Chip ’n Dip is a South African franchise business operating through its Head Office and independently operated franchisees.

3.1 Commitment to privacy

Chip ’n Dip respects the privacy of customers, prospective franchisees, franchisees, event organisers, website visitors, suppliers and other individuals who interact with the business.

Personal information will be processed in accordance with applicable South African data protection legislation, including the Protection of Personal Information Act 4 of 2013 (“POPIA”).

POPIA provides a framework for the lawful processing and protection of personal information in South Africa.

5. EVENT BOOKING INFORMATION

When you submit an Event Booking form, the information supplied may be recorded within Chip ’n Dip’s internal management systems.

The information may be accessed by authorised Head Office personnel and, where appropriate, supplied to a franchisee who may service the event.

Information may include your contact information, event details, expected number of guests, products requested, venue details, event location and other information necessary to evaluate and service your request.

Submitting an Event Booking form constitutes an event enquiry/request and does not automatically confirm the event.


6. FRANCHISE APPLICATION INFORMATION

Information supplied through the Become a Franchisee application may be stored and reviewed by authorised Chip ’n Dip Head Office personnel.

This may include personal, employment, business and financial information reasonably required to assess the application.

Submitting a franchise application:

  • does not guarantee acceptance;

  • does not create a franchise;

  • does not reserve a franchise territory;

  • does not constitute a franchise agreement;

  • does not constitute an offer by Chip ’n Dip;

  • does not guarantee financial performance or profitability; and

  • does not oblige Chip ’n Dip to grant a franchise.

Applications are subject to review and approval by Chip ’n Dip Head Office.

Where an applicant provides consent for lawful credit or other verification checks, relevant information may be processed or supplied to appropriately authorised third parties for that purpose.


7. SHARING OF INFORMATION

Chip ’n Dip may share personal information where reasonably necessary with:

  • Authorised Chip ’n Dip Head Office personnel

  • Relevant Chip ’n Dip franchisees

  • Website and hosting providers

  • IT service providers

  • Email and communications providers

  • Professional advisers

  • Accountants and auditors

  • Legal advisers

  • Payment service providers where applicable

  • Authorised credit or verification providers where applicable

  • Regulatory authorities

  • Law enforcement agencies where legally required

  • Other service providers processing information on behalf of Chip ’n Dip.

11. EVENT BOOKING TERMS AND CONDITIONS

11.1 Event requests

Submitting an Event Booking form is a request for an event and does not constitute automatic confirmation.

An event will only be considered confirmed once confirmation has been provided by Chip ’n Dip, Head Office or the relevant franchisee and any applicable quotation, deposit or booking requirements have been accepted.


11.2 Accurate information

The person submitting an event request is responsible for supplying accurate information concerning:

  • Event date

  • Event start time

  • Event end time

  • Expected number of guests

  • Venue

  • Street address

  • Town or city

  • Province

  • Products required

  • Venue accessibility

  • Available space

  • Electricity requirements where applicable

  • Venue restrictions

  • Other relevant event requirements.

Changes should be communicated as soon as reasonably possible.


11.3 Setup time

Depending on the event and equipment required, setup will generally need to commence approximately one hour before the scheduled event start time.

The event organiser is responsible for ensuring reasonable access to the venue for setup.


12. EVENT ALLOCATION

Chip ’n Dip Head Office may allocate or refer an event enquiry to a suitable franchisee.

Allocation may take into account factors including:

  • Geographic location

  • Franchisee availability

  • Products requested

  • Equipment requirements

  • Event size

  • Operational capacity

  • Existing commitments

  • Other reasonable business considerations.

Submission of an enquiry does not entitle the customer to service by a particular franchisee.


13. EVENT VENUE RESPONSIBILITY

Unless specifically agreed otherwise in writing, the customer or event organiser is responsible for:

  • Obtaining permission to use the venue

  • Providing appropriate access

  • Ensuring the venue is reasonably safe

  • Ensuring adequate operating space

  • Obtaining any required event permits

  • Venue hire

  • Crowd management

  • Municipal permissions

  • Providing electricity or other facilities where agreed as necessary.

Chip ’n Dip and its franchisees reserve the right to refuse to operate where conditions present an unreasonable safety, legal or operational risk.


14. EVENT CHANGES AND CANCELLATIONS

Customers should notify Chip ’n Dip or the allocated franchisee as soon as possible regarding changes or cancellation.

Specific deposits, cancellation charges, refund arrangements and other financial terms may be specified in the quotation or booking confirmation applicable to the particular event.

Any such provisions remain subject to applicable South African consumer law.


15. FRANCHISE APPLICATION TERMS

A franchise application is an expression of interest only.

Chip ’n Dip may consider factors including:

  • Applicant suitability

  • Business experience

  • Qualifications

  • Financial resources

  • Proposed operating area

  • Territory availability

  • Proposed location

  • Existing franchise network

  • Operational capacity

  • Credit information where lawfully obtained

  • Brand suitability

  • Other legitimate business considerations.

Applicants must provide complete and truthful information.

False or materially misleading information may result in an application being rejected or other action being taken where permitted by law.


16. FRANCHISE APPROVAL

Only authorised Chip ’n Dip Head Office personnel may approve a prospective franchisee.

No website submission, email, telephone discussion, meeting or preliminary communication should be interpreted as final approval unless expressly confirmed through the appropriate formal process.

An applicant only becomes a Chip ’n Dip franchisee after the applicable approval requirements and legal processes have been completed and the appropriate franchise agreement has been entered into.


17. FORMAL FRANCHISE AGREEMENT

This website does not constitute the formal Chip ’n Dip Franchise Agreement.

Any successful applicant will be required to enter into the applicable written franchise agreement and receive the documentation required under South African law.

South African consumer-protection regulations contain specific requirements relating to franchise agreements and disclosure documents.

Accordingly, the formal franchise relationship will be governed by the written franchise agreement and applicable legislation rather than these general website terms.

Prospective franchisees should obtain independent legal, financial and business advice before entering into a franchise agreement.


18. FRANCHISEE CODE OF CONDUCT

Chip ’n Dip expects its franchisees to conduct themselves professionally and protect the reputation, standards and integrity of the Chip ’n Dip brand.

Franchisees are expected to:

  • Treat employees professionally

  • Treat fellow franchisees respectfully

  • Cooperate with Head Office

  • Comply with applicable South African legislation

  • Maintain appropriate food safety standards

  • Maintain appropriate hygiene standards

  • Maintain required licences and documentation

  • Maintain required compliance records

  • Use authorised Chip ’n Dip branding appropriately

  • Protect confidential information

  • Protect customer personal information

  • Accurately report information required by Head Office

  • Maintain acceptable customer-service standards

  • Address legitimate customer complaints

  • Cooperate with Head Office evaluations and compliance processes

  • Avoid conduct likely to damage the Chip ’n Dip brand

  • Comply with applicable operating procedures

  • Comply with their signed franchise agreement.

This Code of Conduct does not replace the formal franchise agreement or operational manuals.


19. WEBSITE USE

Users may use the Chip ’n Dip website for lawful purposes only.

Users may not:

  • Impersonate another person

  • Attempt unauthorised access to the website

31. INDEMNITY

To the extent permitted by applicable law, users agree not to hold Chip ’n Dip responsible for losses arising directly from the user’s unlawful use of the website, deliberate provision of false information, infringement of third-party rights or violation of these Terms and Conditions.

32. PAIA – ACCESS TO INFORMATION

The Promotion of Access to Information Act 2 of 2000 (“PAIA”) regulates access to certain records held by public and private bodies.
